More disputes are raised by tenants than by landlords. This is according to research from Decorus for Sage as featured in Landlord Today. This often occurs because there is no clear understanding between the parties to the rental agreement and what is expected from them. One of the biggest issues is the level of cleaning required when tenants move.
In saying that, the number of disputes between landlords and tenants over deposits has fallen. Landlords and tenants are falling out less often over deposits but, and it is a major "but", there are still many thousands of tenancies that end in a row.
What are the arguments about? As mentioned, cleaning is at number one, being an issue in 42% of disputes in 2019-2020. Property damage was a close second, being mentioned in 41% of cases. Disputes over the need to redecorate at the end of a tenancy resulting in 39% of disputes. Gardening and rent arrears also cause problems but not to such a degree.
The principle problem is that landlords don’t often explain clearly enough how the property should be left when their tenants move out. Added to that they don’t always document the condition of the property at the beginning of the tenancy well enough. Problems are caused by there being no evidence for either party to rely on.
