Service Charge Challenges
Service charges are contractual, should be equitable, and must be reasonable, else they are not recoverable. We understand the idiosyncrasies of both residential and commercial service charge recovery, from arranging back years accounting to mediating disputes.
Commercial Property Matters
Licenses to enable alterations
Rarely does a commercial user not want to alter the premises. Our role is to establish whether consent should be granted, to establish that alterations will not damage our Client’s reversionary interest, and to think through end of lease reinstatement provisions. In the alternative, we get businesses growing by ensuring that when taking a lease they have the permissions they need to grow and expand.
We draft commercial leases
We advise on the respective strength of a covenant presented to our Clients or negotiate a position that best protects them. As well as the rent review mechanisms we consider the repairing obligations, end of lease dilapidations, and service charge clauses.
We collect arrears & appoint bailiffs
There are a number of ways to collect commercial arrears: using the security deposit or guarantor agreement, a statutory demand, forfeiture, distress for rent, peaceful re-entry or court proceedings for an injunction, possession or debt recovery. The business debt recovery processes may include Bailiffs and Enforcement Agents.
