Our lease says the Lessors is to employ a firm of qualified Accountants to.... prepare and certify a fair summary in writing of such costs and expenses during the year immediately prior to the Twenty fifth day of March ..... Yet our accounts are over 2 years late: what can we do?
You can report this to is your Local Council who can start the process that could lead to a £2,500 (Level 4 fee) (see Section 25 – Landlord and Tenant Act 1985 - Section 37 – Criminal Justice Act 1982) - which says If you fail to comply with the requirements in sections 21, 22 and 23 of the Landlord and Tenant Act 1985 (see above) without reasonable excuse you will be committing a summary offence and will be liable on conviction to a fine not exceeding level 4 on the standard scale (£2,500).
